機械規則 (EU) 2023/1230 第9章 経過規定及び最終規定
「第９章 経過規定及び最終規定」では、規則の発効日、旧指令の廃止、経過措置などについて規定されています。
機械規則 (EU) 2023/1230は、2027年1月20日から全面適用されます。それ以前から段階的に、古くは2024年7月から部分的にに適用されている。
現行の機械指令2006/42/ECは、2027年1月20日まで適用されます。
現行指令2006/42/ECに従って発行されたEC型式審査証明書は、規則の適用日程に関係なく、その有効期限まで有効です。
以降は、4年に一度、規則についての評価・見直しが繰り返されます。特にAnnex Iの高リスク製品の分類の見直しは、技術の進歩、時代の進展に応じて見直しされることになります。

Article 51: Repeals
第51条 廃止
- Directive 73/361/EEC is repealed.
- Directive 2006/42/EC is repealed with effect from 20 January 2027.
指令73/361/EECは廃止される。
References to the repealed Directive 73/361/EEC shall be construed as references to this Regulation.
廃止された指令73/361/EECへの言及は、本規則への言及とみなされる。
指令2006/42/ECは、2027年1月20日をもって廃止される。
References to the repealed Directive 2006/42/EC shall be construed as references to this Regulation and shall be read in accordance with the correlation table in Annex XII.

Article 52: Transitional provisions
第52条 経過措置
- Member States shall not impede the making available on the market of products which were placed on the market in conformity with Directive 2006/42/EC before 20 January 2027. However, Chapter VI of this Regulation shall apply, from 19 July 2023, mutatis mutandis to such products instead of Article 11 of that Directive, including products for which a procedure has already been initiated under Article 11 of Directive 2006/42/EC.
- EC type-examination certificates and approval decisions issued in accordance with Article 12 of Directive 2006/42/EC shall remain valid until they expire.
加盟国は、2027年1月20日以前に指令2006/42/ECに従って市場に置かれた製品を市場で入手可能にすることを妨げてはならない。ただし、2023年7月19日以降、本規則第VI章は、当該指令第11条に代えて、必要な修正を加えて当該製品に適用されるものとし、これには、指令2006/42/EC第11条に基づき既に手続きが開始されている製品も含まれる。
指令2006/42/EC第12条に従って発行されたEC型式審査証明書及び承認決定は、有効期限まで有効とする。
Article 53: Evaluation and review
第53条 評価及び見直し
- By 20 July 2028 and every four years thereafter, the Commission shall submit a report on the evaluation and review of this Regulation to the European Parliament and to the Council. The reports shall be made public.
- Taking account of technical progress and practical experience gained in Member States as indicated in Article 6, the Commission shall in its report include an evaluation on the following aspects of this Regulation:
欧州委員会は、2028年7月20日までに、またその後4年ごとに、本規則の評価及び見直しに関する報告書を欧州議会及び理事会に提出する。当該報告書は公表される。
欧州委員会は、第6条に規定する加盟国における技術進歩及び実務経験を考慮し、報告書において、本規則の以下の側面に関する評価を含めるものとする。
(a)a summary of data and information provided by Member States in accordance with Article 6(5) during the reporting period;
(a)報告期間中に第6条(5)に従って加盟国から提供されたデータ及び情報の概要。
(b)an assessment of the list of categories of machinery or related products in Annex I in view of the criteria set out in Article 6(4).
(b)第6条(4)に定める基準に照らした附属書Iの機械又は関連製品の分類リストの評価。
In the reports, the Commission shall assess the appropriateness and availability of data and information provided by Member States, including its sufficiency and suitability for the purposes of making comparisons, identifying any shortcomings, necessary to ensure effective functioning and enforcement of Article 6.
委員会は、報告書において、加盟国から提供されたデータ及び情報の適切性及び入手可能性、比較を行うための十分性及び適合性、第6条の効果的な機能及び執行を確保するために必要な欠陥の特定を含め、これらの評価を行うものとする。
Article 54: Entry into force and application
第54条 発効及び適用
This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.
本規則は、欧州連合官報への掲載日から20日後に発効する。
It shall apply from 20 January 2027.
本規則は、2027年1月20日から適用される。
However, the following Articles shall apply from the following dates:

(a)Articles 26 to 42 from 20 January 2024;

(b)Article 50(1) from 20 October 2026;

This Regulation shall be binding in its entirety and directly applicable in all Member States.
本規則は、その全体において拘束力を有し、すべての加盟国において直接適用される。
